Terms and Conditions — WebQR.io

1. Definitions
The following terms are used throughout these Terms and Conditions:
- Company — WebQR.io (referred to as "we", "us", "our"), the operator of the Service.
- Service — the website webqr.io and all associated features, tools, and pages.
- User — any individual aged 16 or over who accesses or uses the Service.
- Content — QR codes, text, images, and other materials created by the User via the Service.
- Cookie — a small data file stored by a browser on the User's device.
- Device — a computer, smartphone, tablet, or other device used to access the Service.
2. Acceptance of Terms
By using the Service, you confirm that you have read, understood, and unconditionally agree to these Terms. If you do not agree with any provision, please discontinue use of the Service immediately.
You must be at least 16 years of age to use the Service. By using the Service, you confirm that you meet this age requirement.
3. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for lawful personal or business purposes.
You may not:
- copy, modify, or create derivative works based on the Service;
- reverse-engineer or decompile the Service's software;
- sell, transfer, or sublicense access to the Service;
- use automated means (bots, scrapers) without our prior written consent.
4. User Responsibility for Content
You are solely responsible for the content you create using the Service.
You may not create QR codes that:
- direct users to malicious, fraudulent, or illegal resources;
- infringe the intellectual property rights of third parties;
- contain malware or phishing links;
- distribute unlawful or harmful content.
We are not responsible for User-generated content but reserve the right to remove any content that violates these Terms.
5. Plans and Payment
The Service offers multiple subscription plans: a free Starter plan with basic features, and paid plans (Premium, Business, Business Plus) with extended capabilities, increased limits, and additional storage. Additional storage may also be purchased separately as a one-time add-on. Current plan descriptions and pricing are available at webqr.io/pricing. 6. Intellectual Property
All rights in the Service, including its software, design, trademarks, and other elements, belong to WebQR.io or are used under licence. These Terms do not transfer any ownership rights in the Service to you. You retain all rights to the content you create using the Service.
7. Cookies
We use cookies to operate the Service, perform analytics, and improve the user experience. Full details are provided in our Privacy Policy at webqr.io/privacy. You may disable cookies in your browser settings; however, this may affect the functionality of the Service.
8. Third-Party Services and Links
The Service may contain links to third-party websites. We do not control their content and are not responsible for it. Following such links is entirely at your own risk. We may use third-party services to operate the platform (analytics, payment providers, etc.). Their use is governed by their own privacy policies.
9. Changes to These Terms
We reserve the right to modify these Terms. We will notify you by email at least 30 days before any changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
10. Modification and Termination of the Service
We may modify, suspend, or discontinue the Service (or any part of it) at any time. Where reasonably possible, we will provide advance notice of material changes. We may immediately suspend or terminate your access to the Service if you breach these Terms. Upon account closure, you will have 30 days to export your content, after which your data may be deleted.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
12. Limitation of Liability
To the maximum extent permitted by law, WebQR.io shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of or inability to use the Service. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless WebQR.io, its employees, partners, and licensors from any claims, losses, and expenses (including legal fees) arising from:
- your breach of these Terms;
- your use of the Service in violation of applicable law;
- your infringement of any third-party rights.
14. Copyright
All content on the Service (text, images, interface, logos) is protected by copyright. Unauthorised copying, distribution, or other use without the prior written permission of WebQR.io is prohibited and may result in legal liability.
15. Suggestions and Feedback
We welcome your suggestions for improving the Service. By submitting suggestions or ideas, you agree that they may be used by us without compensation or obligation to you.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of Georgia. Any disputes arising in connection with the use of the Service shall be resolved by the courts of Georgia at the place of the Company's registration.
17. Short URLs
The Service includes a URL shortening feature that generates short links hosted on our domains. You are solely responsible for the destination URLs encoded in short links. We reserve the right to deactivate any short link that violates these Terms or applicable law. Short link analytics (click counts, geographic and device data) are available in accordance with your subscription plan.
18. API Access
Paid plan users may access the Service via a programmatic API using personal API keys. API keys are confidential and must not be shared. You are responsible for all activity conducted through your API key. We may impose rate limits and usage quotas on API requests. Abuse of the API (including excessive requests, scraping, or circumventing limits) may result in suspension of API access.
19. Workspaces and Team Access
Certain paid plans allow you to create Workspaces — shared environments where multiple team members can collaborate on QR codes and short links.
The Workspace administrator is responsible for managing members and the content created within the Workspace.
QR codes and analytics data within a Workspace are visible to all Workspace members. When a member leaves or is removed from a Workspace, they lose access to the Workspace data, but the data itself remains in the Workspace. If you require a Data Processing Agreement (DPA) for your organisation, please contact us at support.io.
20. Advertising on the Free Plan
Users on the free Starter plan acknowledge that the Service may display third-party advertisements (provided by Google AdSense) on dynamic QR code pages and short-link redirect pages created by the User. Advertisements are not displayed for users on paid plans. WebQR.io does not control the content of third-party advertisements.
